Este artículo es un estudio comparativo de la manera en que Aristóteles y Alexis de Tocqueville conciben a la familia dentro del contexto de la democracia antigua y moderna, respectivamente. Se elabora un recorrido por la institución de la familia y el matrimonio en Grecia y Roma, y sus vinculaciones con las ideas políticas de esas civilizaciones. A survey through the institution of family and marriage in Greece and Rome is made, and their links with the political ideas of those civilizations. In the Western philosophical tradition, thinkers linked to classical realism have resorted to two images to illustrate the realist conception: that of the object that scientists think exists “outside them” and that of the object that “does not depend on them” because they cannot modify or change it at will. Agazzi has exposed in his work why “inside”, “outside” and “Independence” do not seem to him to be schemes usefully applicable in the discussion of realism. This article presents a brief (...) synthesis of the intellectual career of the Italian philosopher and physicist Evandro Agazzi, explaining the influence of Gustavo Bontadini’s objectualism on his epistemological proposal; subsequently, it develops Agazzi’s response to the dispute between idealism and realism based on concepts such as resistance, referentiality, protocolarity and operationality. En la epistemología actual, hay dos actitudes opuestas en relación con las ciencias empíricas.Por una parte, aparecen como herramienta esencial para el avance del conocimiento. Por otro lado, existe duda sobre las bases metafísicas y epistemológicas de esa confianza en el saber científico, lo cual ha llevado a la ciencia por caminos de escepticismo y pragmatismo. Este trabajo se propone aportar filosóficamente a la racionalidad y al estatuto ontológico de la física, teniendo como punto de partida algunas obras del filósofo (...) de la ciencia Evandro Agazzi. El artículo que aquí se presenta introduce al pensamiento de Agazzi y a asuntos nucleares de su epistemología. Posteriormente, define los conceptos de “rigor” y “objetividad” según los entiende Agazzi,finalmente, establece criterios de rigor y objetividad para la física, mostrando de qué manera se verifican en dos experimentos clásicos. Con base en estas ideas, se demuestra que la física, como ciencia que es, cuenta con criterios de rigor y objetividad que le permiten un alcance efectivo de lo real, respondiendo así al desafío formalista y pragmatista. Así pues, el artículo no se agota en una descripción del pensamiento de Agazzi, sino que aplica sus ideas al ámbito concreto de la física, explicitando ideas que no han sido lo suficientemente explicitadas por el filósofo italiano. What happens at the end of a clinical trial for an investigational neural implant? It may be surprising to learn how difficult it is to answer this question. While new trials are initiated with increasing regularity, relatively little consensus exists on how best to conduct them, and even less on how to ethically end them. The landscape of recent neural implant trials demonstrates wide variability of what happens to research participants after an neural implant trial ends. Some former research participants (...) continue to receive support for their devices (e.g., battery and component replacements, software updates, etc.). Others, when safe, have their neural implants removed through surgical explantation. Still others continue to live with a deactivated neural implant embedded in their body. In the United States, there are no uniform requirements to provide services, of any kind, after an neural implant study ends, and other nations are similarly facing this challenge. The existence of a post-trial gap in an expanding neural implant research ecosystem invites obvious questions: What is owed to neural implant research participants post-trial, and why has providing it been so difficult to accomplish in practice? To take a step forward on this difficult issue, we assembled one group of stakeholders – researchers funded for neuroethics grants by the National Institutes of Health – to explore possible starting points on one topic: ethical guidance for post-trial care of research participants in neural implant trials. Based on shared concerns discussed in the expert workshop the current paper is a call to action. It reports the key areas of convergence from the meeting and highlights important next steps towards developing much needed guidance. (shrink)

Advances in genomics have led to calls for developing population-based preventive genomic sequencing programs with the goal of identifying genetic health risks in adults without known risk factors. One critical issue for minimizing the harms and maximizing the benefits of PGS is determining the kind and degree of control individuals should have over the generation, use, and handling of their genomic information. In this article we examine whether PGS programs should offer individuals the opportunity to selectively opt out of the (...) sequencing or analysis of specific genomic conditions or whether PGS should be implemented using an all-or-nothing panel approach. We conclude that any responsible scale-up of PGS will require a menu approach that may seem impractical to some, but that draws its justification from a rich mix of normative, legal, and practical considerations. Dystonia is a movement disorder that can have a debilitating impact on motor functions and quality of life. There are 250,000 cases in the United States, most with childhood onset. Due to the limited effectiveness and side effects of available treatments, pediatric deep brain stimulation has emerged as an intervention for refractory dystonia. However, there is limited clinical and neuroethics research in this area of clinical practice. This paper examines whether it is ethically justified to offer pDBS to children with (...) refractory dystonia. Given the favorable risk-benefit profile, it is concluded that offering pDBS is ethically justified for certain etiologies of dystonia, but it is less clear for others. In addition, various ethical and policy concerns are discussed, which need to be addressed to optimize the practice of offering pDBS for dystonia. Strategies are proposed to help address these concerns as pDBS continues to expand. (shrink)

This paper examines how the application of legal fiduciary principles , can serve as a framework to promote management of clinical genomic “incidental” or secondary target findings that is patient-centered and consistent with recognized patient autonomy rights. The application of fiduciary principles to the clinical genomic testing context gives rise to at least four physician fiduciary duties in conflict with recent recommendations by the American College of Medical Genetics and Genomics . In this article, we sketch how theoretical neuroethics can clarify the concept of autonomy. We hope that this can both serve as a model for the conceptual clarification of other components of PIAAAS and contribute to the development of the empirical measures that Gilbert and colleagues [1] propose.

En el presente artículo nos enfocare-mos en desarrollar las concepciones antropológicas de dos autores renacen-tistas: Marsilio Ficino y Giovanni Pico della Mirandola. En este sentido, nuestro recorrido parte de las lectu-ras propias de diversas obras de ambos autores, pero prestando especial interés en De vita libri tres de Ficino y en Oratio de hominis dignitate de Pico. En ellas nuestros autores destacan la importancia de una concep-ción antropológica regida por los ideales humanistas del Renacimiento y cómo éstas son atravesadas por (...) di-versas categorías paganas en general y herméticas en particular. El objetivo del presente trabajo es elucidar la vigencia que presenta el programa de investigación de Habermas para interpretar críticamente un fenómeno social de creciente notoriedad en los diversos escenarios políticos occidentales: los procesos de interacción discursiva en las plataformas digitales. Para ello, en primer lugar, ofrecemos un acercamiento preliminar al problema al contrastar la noción clásica de esfera pública habermasiana con el nuevo fenómeno de los espacios de interacción digital. A través de este primer abordaje, señalamos la importancia de (...) conceptualizar el fenómeno en cuestión desde el modelo de la racionalidad comunicativa. Por ello, en segundo lugar, analizamos la vigencia que presenta la distinción habermasiana entre consenso y pseudoconsenso para interpretar la vitalidad propia de las interacciones en las redes sociales. Por medio de este análisis, concluimos que, desde el modelo de la racionalidad comunicativa, el fenómeno estudiado da lugar a una nueva especie híbrida de pseudoconsenso. (shrink)

El objetivo de este artículo es a nalizar el Dialogo Social y el Tripartismo en Venezuela, explanando los distintos elementos que conforman cada uno de estos conceptos, al mismo tiempo se presentan los antecedentes del proceso de diálogo social y tripartismo en Venezuela. La metodología utilizada se encuentra enmarcada en una investigación tipificada como aplicada, documental y descriptiva, se tipificó el diseño de la investigación bibliográfico, las técnicas e instrumentos de recolección de datos utilizados fueron la selección y verificación de (...) documentación escrita. De los resultados se desprende que las funciones del dialogo social, pueden observarse desde distintas perspectivas, para lograr consensos, para a través de la discusión puedan evitarse situaciones de conflicto, para debatir en torno a temas vinculados a lo económico, laboral y social. Hoy en día en la Ley Orgánica del Trabajo, los trabajadores, y las trabajadoras queda excluida la participación de la Comisión Tripartita Nacional, y por ende, toda intervención en la toma de decisiones o recomendaciones en virtud de la fijación del salario minino. Es la razón por la cual, se sostiene el hecho de que son necesarios estos mecanismos de concertación para crear una sociedad justa y democrática. (shrink)

A pesar de las dificultades que implica una investigación históricamente tan extensa, lo que resulta evidente de la categoría de naturaleza es su carácter plurívoco, ya que el concepto, en tanto categoría filosófica, ha sufrido múltiples transformaciones con (...) el paso del tiempo. Este trabajo busca describir las construcciones de eth del quichua santiagueño de acuerdo con dos parámetros: a) el grado de solapamiento semántico entre los predicados de la construcción de eth, y b) el grado de integración eventiva de la adverbial inicial con la cláusula principal. El primer parámetro permite identificar construcciones verbatim –con repetición exacta del verbo anterior– (...) y no verbatim –sin repetición exacta–. El segundo parámetro se manifiesta en la forma que adopta la cláusula “cabeza”. Así, se identificaron, por un lado, una forma converbal y, por el otro, cláusulas con los sufijos del sistema de conmutación de la referencia. This paper aims to describe THL constructions in Santiagueño Quichua according to two parameters: a) the degree of semantic overlap between the predicates of the THL constructions, and b) the degree of event integration of the preposed adverbial with its main clause. The first parameter allows the identification of verbatim constructions -with exact repetition of the previous predicate- and non verbatim constructions -without exact repetition-. The second parameter manifests itself in the form the head clause might adopt, where it is a converb or it takes switch reference suffixes. The interplay of both parameters shows that the different THL constructions possess diverse discourse functions, particularly regarding thematic coherence. (shrink)

El presente trabajo busca hallar en la presencia de la diosa Venus a lo largo de todo el poema una dimensión ordenadora que la distinguiría de cualquier entidad divina tradicional. Proponemos, (...) pues, que nuestra diosa personifica el _ordenamiento_ de la naturaleza y la reintegración del orden social al orden natural. El _filósofo_ Lucrecio, en su lucha contra la divinidad, presenta a Venus como un elemento que expresa una racionalización del universo en términos políticos. Para sustentar nuestra hipótesis, hemos accedido al latín de Lucrecio para identificar en él conceptos de la política romana asociados indiscutiblemente al gobierno de la naturaleza, que nuestra diosa preside. The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)

Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Patient narratives from two investigational deep brain stimulation trials for traumatic brain injury and obsessive‐compulsive disorder reveal that injury and illness rob individuals of personal identity and that neuromodulation can restore it. The early success of these interventions makes a compelling case for continued post‐trial access to these technologies. Given the centrality of personal identity to respect for persons, a failure to provide continued access can be understood to represent a metaphorical identity theft. Such a loss recapitulates the pain of (...) an individual's initial injury or illness and becomes especially tragic because it could be prevented by robust policy. A failure to fulfill this normative obligation constitutes a breach of disability law, which would view post‐trial access as a means to achieve social reintegration through this neurotechnological accommodation. Background Deep brain stimulation is approved for treating refractory obsessive-compulsive disorder in adults under the US Food and Drug Administration Humanitarian Device Exemption, and studies have shown its efficacy in reducing symptom severity and improving quality of life. While similar deep brain stimulation treatment is available for pediatric patients with dystonia, it is not yet available for pediatric patients with obsessive-compulsive disorder, although soon could be. The prospect of growing indications for pediatric deep brain stimulation raises several ethical concerns relating (...) to bodily integrity, the ability to offer informed assent, and the role pediatric patients play in the decision-making process. Objective The aim of this study is to solicit and assess the views of stakeholders (children, parents, clinicians) on pediatric assent, autonomy, and bodily integrity in the context of potential pediatric deep brain stimulation for obsessive-compulsive disorder. Methods Semi-structured interviews were conducted with pediatric obsessive-compulsive disorder patients ( n = 21), caregivers of pediatric obsessive-compulsive disorder patients aged 14–18 ( n = 19), and clinicians with experience treating refractory obsessive-compulsive disorder ( n = 25). Interviews were transcribed and coded in MAXQDA 2018 and 2020 software and processed for thematic content analysis to isolate and compare specific themes. Results A majority of respondents (74%, 48/65) across all three stakeholder groups voiced that the decision-making process should be collaborative and involve everyone (clinicians: 84% or 21/25, caregivers 71% or 15/21, and patients 63% or 12/19). We identified a split between respondents’ views on who should have the final say in the event of disagreement (38% or 25/65 favored the patient versus 35% or 23/65 favoring caregivers). A split between respondents also emerged concerning the maturity relevant for deep brain stimulation decision-making, with 45% (29/65) favoring developmental maturity (age/physiological development) and 45% (29/65) favoring decisional maturity (capacity to understand and weigh information). A majority of clinicians indicated that they would not move forward with deep brain stimulation without securing patient assent (80% or 20/25), with some stating the only exception is if patient quality of life was very poor and/or they lacked insight. Both caregivers and patients expressed a significant respect for the patient's right to bodily integrity, with 67% of caregivers (14/21) and 68% of patients (13/19) justifying patient involvement in decision-making specifically with reference to infringements of bodily integrity. Conclusion Our findings demonstrate that despite broad agreement across stakeholders that the decision-making process for pediatric deep brain stimulation for obsessive-compulsive disorder should be collaborative and somehow involve pediatric patients, there is disagreement about what this process entails and what factors determine patient involvement in the process. However, there is agreement that children have a right to bodily and brain integrity, which should only be infringed upon in rare circumstances. (shrink)

Preimplantation genetic testing for polygenic disorders (PGT-P) has been commercially available since 2019. PGT-P makes use of polygenic risk scores for conditions which are multifactorial and are significantly influenced by environmental and lifestyle factors. If current predictions are accurate, then absolute risk reductions range from about 0.02% to 10.1%, meaning that between 10 and 5,000 in vitro fertilization patients would need to be tested with PGT-P to prevent one offspring from becoming affected in the future, depending on the condition and (...) the number of embryos available. Survey and interview data reveal that patients and the public have largely favorable views regarding the use of PGT-P for disease prevention; however, clinicians and professional organizations have many reservations. The use of PGT-P raises multiple social and ethical concerns including the need for adequate counseling, the setting of realistic expectations, the application of distributive justice, the impact of environmental and social determinants of health, and the potential exacerbation of health inequities. Clinicians expressed significant concerns relating to the cost of PGT-P, the potential time-consuming counseling for reproductive endocrinologists and genetic counselors, the intentional creation of supernumerary embryos, and patients’ unrealistic expectations regarding “healthiest disease-free” embryos. Furthermore, current evidence lacks long-term outcome data and generalizability. Prior to offering PGT-P to patients, additional clinical validation studies are needed. Also, ethical and social considerations raised by PGT-P should be carefully delineated. Systemic practices to increase equitable access to unbiased genetic counseling and reproductive services would be desirable prior to the ethical implementation of PGT-P. (shrink)

The expansion of research on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises important neuroethics and policy questions related to data sharing. However, there has been little empirical research on the perspectives of experts developing these technologies. We conducted semi-structured, open-ended interviews with aDBS researchers regarding their data sharing practices and their perspectives on ethical and policy issues related to sharing. Researchers expressed support for and a commitment to sharing, with most saying that they were either sharing their data (...) or would share in the future and that doing so was important for advancing the field. However, those who are sharing reported a variety of sharing partners, suggesting heterogeneity in sharing practices and lack of the broad sharing that would reflect principles of open science. Researchers described several concerns and barriers related to sharing, including privacy and confidentiality, the usability of shared data by others, ownership and control of data (including potential commercialization), and limited resources for sharing. They also suggested potential solutions to these challenges, including additional safeguards to address privacy issues, standardization and transparency in analysis to address issues of data usability, professional norms and heightened cooperation to address issues of ownership and control, and streamlining of data transmission to address resource limitations. Researchers also offered a range of views on the sensitivity of neural activity data (NAD) and data related to mental health in the context of sharing. These findings are an important input to deliberations by researchers, policymakers, neuroethicists, and other stakeholders as they navigate ethics and policy questions related to aDBS research. Harcourt argues that in clinical contexts, children and young people with mental health illness can experience epistemic, specifically testimonial, injustice when their perspectives are unjustifiably discounted by health service providers.1 Our goal in this commentary was to illustrate how caregivers, a critical component of CYP treatment triad, can also engage in testimonial injustice towards CYP patients. Testimonial injustice occurs when one suffers a credibility deficit and that credibility deficit is based on prejudice.2 Harcourt expands Fricker’s account of testimonial injustice by (...) arguing that for CYPs, the credibility deficits attributed to them by clinicians, for example, may result from epistemic arrogance in that CYPs are viewed as having unreliable knowledge about their condition. Harcourt writes: ‘Being a CYP is treated as a heuristic for epistemic unreliability across a wide range of domains’, including clinical settings. Harcourt’s expansion of Fricker’s account thus includes epistemic arrogance as an alternative necessary condition, in addition to prejudice, to apply the concept of testimonial injustice. We think Harcourt’s argument can also be extended to caregivers, who are central to the CYP treatment triad. The life project is an exercise in awareness that begins with imagining what you want to be and be aware of the relationship with the world. Leisure is lived from internal motivations and is auto-condicionated to seek the opportunities realization of dreams. Education for Leisure must recover the ideals of (...) life, learning to live the leisure, and spark the imagination for the realization of dreams.
